HomeMy WebLinkAboutNiska Dispute Resolution Policies and Procedures Info Sheet Tsuut’ina Legislative Procedures – Nisk’a Dispute Resolution Policies and Procedures The purpose of this policy is to provide an unbiassed, orderly, transparent and accountable process to resolve disagreements surrounding Nisk’a Assignment, which will apply to Tsuut’ina citizens. This process recognizes the ultimate authority of Head Chief and Minor Chief in right of the non-designated Nisk’a within Tsuut’ina. The Process includes A dispute form and file that shall be completed and forwarded to the Land Manager and the Lands Clerk shall, without delay, commence opening a file to initiate the Nisk’a Dispute Resolution Process as a claim. The policy includes a list of the documents that the file must include, if the file is not complete , it will not proceed forward. Any disputes that include a Nation citizen who has passed away shall be delayed for one year. Claimant and Respondent shall attend an information session on ‘Nisk’a 101’, and any field monies or reviews will be held in trust until the dispute is resolved. Once the file meets the criteria, then what happens? The File will be recommended to proceed to Peacemaking and notification will be sent to Head Chief and Minor Chiefs. Third party mediation option/ recommendations will be ratified by Head Chief Minor Chief. Is there any reason why a claim would not proceed? Yes. Within this policy, there are several reasons a claim would not proceed including but not limited to; the claim has already been decided, in-house documentation nullifies claim, fraud, intimidation and threats of violence, illegal activity, unexcused or continued non-attendance at agreed upon meetings and or not complying to this Policy or the Accountability Code.
